Seminar summary

Obligation on both prosecutor and defence advocate to advance defence of mental disorder or unfitness to stand trial when client may be unable to give instructions to do so, or wishes not to advance such a defence.

Criminal law and mental capacity: issues concerning mental disorder defence and other cognitive issues that may arise at criminal trial are discussed, such as taking statements and investigating accused persons who lack cognitive skills. The issue of fitness to stand trial is also discussed. The verdict of not criminally responsible is explained, as are the treatment options for such persons
